Your Submissions

Except for any personal information we may collect from you under the guidelines in our Privacy Policy, any material, information, or other communication you transmit, upload, or post to this Site (“Submissions”) will be considered non-confidential and non-proprietary. WATG will have no obligations with respect to the Submissions and you hereby waive all rights to any claim against us for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with such Submissions. Indemnification

Governing Law 

These Terms of Use shall be governed by, and construed and enforced in accordance with, the laws of the state of California, without regard to conflicts of law principles.   The United Nations Convention on Contracts for the International Sale of Goods is expressly disclaimed.

WATG makes no representation that materials in the Site are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited.

Dispute Resolution

Any cause of action by you with respect to the Site, including, but not limited, to these Terms of Use, shall be resolved by binding arbitration before a single arbitrator under the International Rules of Arbitration of the American Arbitration Association in accordance with the substantive law of the State of California, and will be conducted in Orange County, California. Any arbitration award may be entered into and enforced by any court having jurisdiction and shall be final and binding upon the parties.

Severability

If any part of these Terms of Use is declared unlawful, void, or for any reason unenforceable by any court in any jurisdiction, then such term will be deemed severable from the remaining terms in such jurisdiction and will not affect the validity and enforceability of such remaining terms.

Claims of Infringement

If you believe that any content appearing on this Site infringes your copyright rights, WATG wants to hear from you. Please forward the following information in writing to the Copyright Agent at the address listed below.

Privacy Policy

This Privacy Policy discloses the privacy practices  for WATG Holdings Incorporated, including its subsidiaries and affiliates (“WATG,” “we,” “us,” or “our”), and describes how Personal Information is collected, used, shared, stored, or otherwise processed in connection with its products, services, and websites both online and offline (collectively, the “Services”). “Personal Information” means any information or set of information that relates to an individual, which can be either direct or indirect. This Privacy Policy applies to all Personal Information received and processed by WATG that you provide either verbally, online, in person, or in written form. This Policy also extends to the data handling practices by our contractors, vendor business associates, and service providers (collectively referred to as ‘third-parties’) involved the collection, use and/or processing of Personal Information.

Information collection & use

The type of information WATG collects from you depends on the purpose with which you engage with the us, our employees or Third Parties. The following describes instances in which we may collect information and the ways in which your Personal Information may be used.

Clients & Vendors

If you are one of our clients or business associates, we collect contact information and contact preferences (such as name, email address, mailing address, and phone number) in order to:

  • Perform Services, such as fulfilling orders and providing you with the products and services you request from us,
  • Establish and maintain communications with you, and
  • Distribute our marketing materials.

Job Applicants & Employees

If you are a job applicant or employee, we will collect parts or all of the information listed below, in order to assess your skills, experience, and suitability for a particular position or fulfill our contractual obligations as your employer:

  • Contact information and contact preferences (such as name, email address, mailing address, phone number, and emergency contact information),
  • Details related to your work history and related experience captured during the recruitment, interview, and hiring process,
  • Information about your interest in available positions at WATG,
  • Publicly available information provided by you, found on recruiting or social media sites,
  • Information needed to complete a background investigation prior to extending an employment offer,
  • Social security number to validate your identity,
  • Biographical and demographic information (such as date of birth, age, gender, ethnicity, marital status), and
  • Financial information, such as bank account and routing numbers in order to pay salary or wages.

Website Users

We collect two basic types of information from you in conjunction with your use of WATG’s website www.watg.com (the ‘Site”) – Personal Information and Non-Personal Information. Non-Personal Information includes information that does not personally identify you but may include tracking and usage information about your location, demographics, use of the Site and the internet. For more details on how Non-Personal Information is processed, refer to the “Use of Cookies” section. The following list contains the type Personal Information we may collect in connection with using our Site:

  • Account set up information to register for an account on the Site to submit an online job application (such as name, email, phone, account password or log in details),
  • Contact information and contact preferences (such as name, email address, country, reason for contacting WATG) to sign up to receive email newsletters or other information from us,

  • Participation in surveys, special events, and promotions,
  • Purchases on the Site, and

Use of cookies

When you interact with the Site, we may automatically receive and record information on our server logs from your browser, including your IP address, “cookie” information, and the page you requested.

Cookies and other tracking technologies (such as browser cookies, pixels, beacons, and Adobe Flash technology including cookies) are comprised of small bits of data that often include a de-identified or anonymous unique identifier. California Do Not Track Disclosures

At this time, we do not respond to do-not-track signals from browsers or other consumer choice mechanisms regarding the collection of behavioral tracking data. While we collect Personal Information from you as described above, we do not collect Personal Information from you to monitor your online activities across third-party websites or online services and over time (also known as behavioral advertising or interest-based advertising). We do not use or allow third parties to collect Personal Information from you on the Site in order to monitor your online activities across third-party websites or online services and over time.

Email and Other Communications

We may contact you, by email or other means. For example, we may send you promotional offers or a newsletter. If you do not want to receive emails from us, please let us know through the “unsubscribe” feature included in our communications.

Our Disclosure of Information

We do not and will not sell your Personal Information to any third-party outside of WATG and will only share Personal Information as provided below and within our company.

Service Providers

We may make your information available to certain third-party service providers, such as contractors, agents, or sponsors, who help us manage or provide the services offered on our Site, such as hosting, billing, marketing, analytics, customer service, fraud protection, etc. We may need to share your Personal Information with them, but we require that all of our service providers keep Personal Information confidential and not disclose it to third parties and not use it for any other purpose.

In order to enable any of these rights, WATG will verify your identity prior to fulfilling a request for Personal Information. This helps ensure that we provide the requested information only to the individuals to whom it pertains or their authorized representatives. If you are an authorized agent making a request on behalf of another individual, we may require additional information to verify that you are authorized to make that request. This may include obtaining a written authorization and proof that you are authorized to make the request.

In the event that a privacy right request cannot be completed, WATG will provide you with an explanation for the denial, subject to any legal or regulatory restrictions.

Response Time

We will use reasonable efforts to respond to your request and it could take up to 30 days or longer to receive a response. If we believe that more time is required, we will notify of you our intended deadline extension in order to fulfill your request.

EU data protection practices

Sensitive Information

Sensitive Personal Information refers to certain Personal Information that carry increased risk to the individual if compromised. Sensitive Personal Information can include but is not limited to social security or other identity numbers, data about your personal life (including health, genetic and biometric information), racial or ethnic origin, nationality, political membership, religious affiliation, sexual orientation or other similar information. This information is generally not collected by WATG. If we were to collect sensitive Personal Information from you, we obtain your prior express permission and would explain how we intended to use such information.

International Data Transfers

Your Personal Information may be stored and processed in any country where we have facilities or service providers and may be transferred to countries outside your country of residence in connection with use of our Services. Other countries may have different data protection rules than the ones in your country. Appropriate contractual and other measures are in place to protect Personal Information when it is transferred to our affiliates or third parties in other countries.

Some non-European Economic Area (EEA) countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards. Security

We are concerned about ensuring the security of your Personal Information. We use reasonable efforts to protect your Personal Information collected through the Site from access, loss, misuse, alteration, or destruction by any unauthorized party. Children’s Online Privacy

WATG respects the privacy of children and we are committed to complying with the Children’s Online Privacy Protection Act (“COPPA”). This Site does not knowingly collect, solicit, use, or disclose Personal Information from children under the age of 13. If you are under 13, please do not attempt to register for the Site or send any information about yourself to us. No one under age 13 may provide any Personal Information to us. If we learn that a child under 13 has provided Personal Information to us without verification of parental consent, we will delete that information immediately.

We remind and encourage all parents to check and monitor their children’s online activities. Parents have the right to review and have deleted any Personal Information we may have inadvertently collected from their children and refuse to permit further collection of that information. WATG is also committed to protecting the online privacy rights of minors under the age of 18. If you are a California resident under the age of 18, you may request the removal of any user content or information posted by you on our Site by contacting us at legal@watg.com. In your request, please specify clearly what information you have posted that you would like us to remove. We will comply with your request as soon as practicable.
